Why: A system to provide an opportunity to the common public to raise concern against any trademark after passed by trademark office which may be deceptively or phonetically similar to their owner of other existing marks.

Who can file: Any person irrespective of the fact of his commercial or personal interest.

Time period: within a period of three months from the date of its publication in Trademark journal extendable to a maximum one more month.

Possible Grounds: Under sections 9 (absolute grounds of refusal), 11 (relative grounds), 13, 14 and 18 (1) of The Trade Marks Act, 1999, in India.
